Subject:- Waiving of excess amount of Non-Practicing Allowance(NPA) paid to Pre-1996 retired Armed Forces Doctors.
Reference:- This office important circular No. 5 bearing file No. G-1/M/01/ICOs/NPA dated 29.01.2009.

The reference is invited towards this office important circular referred
above (enclosed as Annexure 'A') in which it was requested that
Corrigendum PPO issued by this office in implementation of Govt. letter
No. 1(1)/99/D(Pen/Ser) dated 11.09.2001 reducing the pension w.e.f.
01.01.1996 may be acted upon. However, recovery of excess payment made
to the pensioners after 11.09.2001 may not be made till further order.
In cases where recoveries are in progress, no further recovery should be
affected till further orders.
Now, order has been issued by the Govt. of India, Ministry of Defence vide letter No. F.No. 7(4)/2008/D (Pension/Legal) dated 18.12.2013 to waive recovery of excess amount of element of NPA paid to pre-96 retired Armed Forces Doctors for the period from 11.09.2001 to 31.03.2008. The copy of Govt. of India, Ministry of Defence
letter No. F.No. 7(4) /2008/D (Pension/Legal) dated 18.12.2013 is
enclosed herewith as Annexure-B for information and necessary action by
all concerned.
The Pension Disbursing Authorities may ensure that recovery of excess amount of element of NPA paid to pre-96 retired Armed Forces Doctors
for the period from 11.09.2001 to 31.03.2008 may not be made as the
same has been waived by the Govt vide above order. However, amount of excess amount of the element of NPA recovered so far is not to be refunded in accordance with Para 3 of Govt. of India, Ministry of Defence letter No. F.No. 7(4) /2008/D(Pension/Legal) dated 18.12.2013.

It is requested that a copy of these orders / instructions may be provided to all CPPCs, link banks, Paying branches/ Treasuries under your jurisdiction.
The order has also been uploaded

Sub : Reduction of pension in terms of Min. of Def. letter No. 1(1)/99/D(Pen/Sers) dated 11.9.2001 on account of not taking into account NPA for computing pension under modified parity.
Reference is invited to this office Important Circular No. 1 & 3
bearing no GI/M/01/NPA dated 20-05-2002 & Dated 12-06-2002 (for
disbursing authorities Kolkata / West Bengal) Important Circular No. 2 bearing no GI/M/01/NPA dated 20-05- 2002 (for disbursing authorities excluding west Bengal) and Important Circular
No. 4 bearing no GI/M/01/NPA dated 17-07-2002 (for disbursing
authorities New Delhi /Delhi Area) issued in implementation of interim
stay orders of various High Courts against reduction of pension as well
as recovery of overpaid pension in terms of Min. of Def. letter No.
1(1)/99/D(Pen/Sers) dated 11.9.2001 on account of not taking into
account Non Practicing Allowance (NPA) for computing pension under modified parity order. The above circulars are superseded with this circular.
As per clarification received from MOD vide their ID No 113 A/D
Pen/Legal), dated 5-12-2008 and GOI, MOD letter no 113/A/D (Pen/Sers)
Pt/D (Pen/Legal) dated 18-04-2007 in pursuance of Supreme Court order
dated 10-10-2006,the revision of pensions of medical officers have been
examined and it is stated that the pension of medical officers would be
revised without taking into account the Non- Practicing Allowances (NPA)
element.
It is accordingly requested that corrigendum PPOs issued by this office
in implementation of Got. Letter No. 1(1)/99/D/Pen/Sers) dated
11.09.2001 reducing the pension w.e.f. 1.1.96 may be acted upon .However
recovery of excess payment made to the pensioners after 11-09-2001 may
not be made till further order. In cases where recoveries are in
progress, no further recoveries should be effected till further order.
